Depending on the services they provide and due to the specific risks raised by each type of services, crypto-asset service providers should be subject to requirements specific to those services. Crypto-asset service providers providing custody and administration of crypto-assets on behalf of clients should conclude an agreement with their clients with certain mandatory provisions and should establish and implement a custody policy, which should be made available to clients upon their request in an electronic format. Such agreement should specify, inter alia, the nature of the service provided, which could include the holding of crypto-assets belonging to clients or the means of access to such crypto-assets, in which case the client might keep control of the crypto-assets in custody. Alternatively, the crypto-assets or the means of access to them could be transferred to the full control of the crypto-asset service provider. Crypto-asset service providers that hold crypto-assets belonging to clients, or the means of access to such crypto-assets, should ensure that those crypto-assets are not used for their own account. The crypto-asset service providers should ensure that all crypto-assets held are always unencumbered. Those crypto-asset service providers should also be held liable for any losses resulting from an incident related to information and communication technology (\u2018ICT\u2019), including an incident resulting from a cyber-attack, theft or any malfunctions. Hardware or software providers of non-custodial wallets should not fall within the scope of this Regulation.<\/span><\/p>\n

Th\u1ecfa thu\u1eadn l\u01b0u k\u00fd ph\u1ea3i n\u00eau r\u00f5 t\u00ednh ch\u1ea5t d\u1ecbch v\u1ee5, bao g\u1ed3m vi\u1ec7c l\u01b0u gi\u1eef t\u00e0i s\u1ea3n m\u00e3 h\u00f3a c\u1ee7a kh\u00e1ch h\u00e0ng ho\u1eb7c qu\u1ea3n l\u00fd ph\u01b0\u01a1ng ti\u1ec7n truy c\u1eadp \u0111\u1ebfn t\u00e0i s\u1ea3n (v\u00ed d\u1ee5: private key). Trong m\u1ed9t s\u1ed1 tr\u01b0\u1eddng h\u1ee3p, kh\u00e1ch h\u00e0ng v\u1eabn duy tr\u00ec quy\u1ec1n ki\u1ec3m so\u00e1t t\u00e0i s\u1ea3n trong l\u01b0u k\u00fd; \u1edf tr\u01b0\u1eddng h\u1ee3p kh\u00e1c, quy\u1ec1n truy c\u1eadp c\u00f3 th\u1ec3 \u0111\u01b0\u1ee3c chuy\u1ec3n giao to\u00e0n b\u1ed9 cho CASP.<\/span><\/p>\n

CASP c\u00f3 quy\u1ec1n ki\u1ec3m so\u00e1t t\u00e0i s\u1ea3n ho\u1eb7c kh\u00f3a truy c\u1eadp c\u1ee7a kh\u00e1ch h\u00e0ng ph\u1ea3i \u0111\u1ea3m b\u1ea3o kh\u00f4ng s\u1eed d\u1ee5ng t\u00e0i s\u1ea3n \u0111\u00f3 cho m\u1ee5c \u0111\u00edch ri\u00eang<\/strong>, v\u00e0 c\u00e1c t\u00e0i s\u1ea3n \u0111\u01b0\u1ee3c l\u01b0u tr\u1eef ph\u1ea3i lu\u00f4n trong t\u00ecnh tr\u1ea1ng kh\u00f4ng b\u1ecb r\u00e0ng bu\u1ed9c (unencumbered)<\/strong>.<\/span><\/p>\n

    MiCA c\u00f4ng nh\u1eadn r\u1eb1ng m\u1ed7i lo\u1ea1i d\u1ecbch v\u1ee5 crypto ti\u1ec1m \u1ea9n r\u1ee7i ro kh\u00e1c nhau.     CASP ph\u1ea3i ch\u1ecbu tr\u00e1ch nhi\u1ec7m n\u1ebfu x\u1ea3y ra m\u1ea5t m\u00e1t t\u00e0i s\u1ea3n do l\u1ed7i b\u1ea3o m\u1eadt, t\u1ea5n c\u00f4ng m\u1ea1ng, \u0111\u00e1nh c\u1eafp kh\u00f3a truy c\u1eadp, l\u1ed7i k\u1ef9 thu\u1eadt\u2026<\/strong><\/span>
