\ud83d\udcd8 Article 66 \u2013 Authorisation and operating conditions for the issuance of e-money tokens<\/strong><\/span><\/h2>\n

(\u0110i\u1ec1u ki\u1ec7n \u0111\u01b0\u1ee3c c\u1ea5p ph\u00e9p v\u00e0 ho\u1ea1t \u0111\u1ed9ng \u0111\u1ed1i v\u1edbi vi\u1ec7c ph\u00e1t h\u00e0nh token ti\u1ec1n \u0111i\u1ec7n t\u1eed)<\/em><\/span><\/p>\n

Issuers of e-money tokens shall be authorised either as a credit institution in accordance with Directive 2013\/36\/EU or as an electronic money institution in accordance with Directive 2009\/110\/EC.<\/strong><\/span><\/p>\n

E-money tokens shall be considered as \u201celectronic money\u201d as defined in Directive 2009\/110\/EC. Except where otherwise provided in this Regulation, issuers of e-money tokens shall comply with the requirements applicable to the taking-up, pursuit and prudential supervision of the business of electronic money institutions under Directive 2009\/110\/EC, as well as with the requirements on issuance and redemption of e-money tokens.<\/em><\/span><\/p>\n

Issuers shall also draw up a crypto-asset white paper and notify it to the competent authority.<\/em><\/span><\/p>\n

In addition, exemptions concerning limited networks, certain transactions by providers of electronic communications networks and services, and electronic money institutions issuing only a limited amount of e-money, as provided for in the optional exemptions set out in Directive 2009\/110\/EC, shall apply.<\/em><\/span><\/p>\n

However, such issuers may be required to draw up a crypto-asset white paper in order to provide holders with information about the rights, obligations and risks associated with e-money tokens and shall notify the white paper to the competent authority prior to publication.<\/em><\/span><\/p>\n
