C\u00e1c quy\u1ec1n h\u1ea1n h\u00e0nh ch\u00ednh theo c\u1ea3 Ch\u1ec9 th\u1ecb v\u00e0 Quy \u0111\u1ecbnh MiCA \u0111\u1ec1u \u00e1p d\u1ee5ng, bao g\u1ed3m quy\u1ec1n h\u1ea1n \u0111\u1ec3 h\u1ea1n ch\u1ebf ho\u1ea1t \u0111\u1ed9ng ho\u1eb7c t\u1ea1m d\u1eebng vi\u1ec7c ch\u00e0o b\u00e1n token. Khi c\u00f3 s\u1ef1 ch\u1ed3ng l\u1ea5n ngh\u0129a v\u1ee5 gi\u1eefa hai khung ph\u00e1p l\u00fd, t\u1ed5 ch\u1ee9c t\u00edn d\u1ee5ng ph\u1ea3i tu\u00e2n th\u1ee7 \u0111i\u1ec1u kho\u1ea3n c\u1ee5 th\u1ec3 ho\u1eb7c nghi\u00eam ng\u1eb7t h\u01a1n. Th\u1ee7 t\u1ee5c th\u00f4ng b\u00e1o theo MiCA kh\u00f4ng l\u00e0m \u1ea3nh h\u01b0\u1edfng \u0111\u1ebfn quy \u0111\u1ecbnh trong lu\u1eadt qu\u1ed1c gia v\u1ec1 c\u1ea5p ph\u00e9p theo Ch\u1ec9 th\u1ecb 2013\/36\/EU&#8221;.<\/span><\/p>\n<p><strong>Tr\u00edch lu\u1eadt MICA:<\/strong><\/p>\n<p style=\"text-align: justify;\"><em>&#8220;(44) Las entidades de cr\u00e9dito autorizadas con arreglo a la Directiva 2013\/36\/UE no deben necesitar otra autorizaci\u00f3n en el marco del presente Reglamento para ofertar o solicitar la admisi\u00f3n a negociaci\u00f3n de fichas referenciadas a activos. Deben aplicarse los procedimientos nacionales establecidos con arreglo a dicha Directiva, pero deben complementarse con la obligaci\u00f3n de notificar a la autoridad competente del Estado miembro de origen designada con arreglo al presente Reglamento los elementos que permitan a dicha autoridad verificar la capacidad del emisor para ofertar o solicitar la admisi\u00f3n a negociaci\u00f3n de fichas referenciadas a activos. Las entidades de cr\u00e9dito que oferten o soliciten la admisi\u00f3n a negociaci\u00f3n de fichas referenciadas a activos deben estar sujetas a todos los requisitos aplicables a los emisores de fichas referenciadas a activos, con excepci\u00f3n de los requisitos de autorizaci\u00f3n, los requisitos de fondos propios y el procedimiento de aprobaci\u00f3n con respecto a los accionistas cualificados, ya que estas cuestiones est\u00e1n reguladas por la Directiva 2013\/36\/UE y por el Reglamento (UE) n. o 575\/2013 del Parlamento Europeo y del Consejo (17). Todo libro blanco de criptoactivos elaborado por una entidad de cr\u00e9dito de ese tipo debe ser aprobado por la autoridad competente del Estado miembro de origen antes de su publicaci\u00f3n. Las entidades de cr\u00e9dito autorizadas con arreglo a las disposiciones de Derecho nacional por las que se transponga la Directiva 2013\/36\/UE y que oferten o soliciten la admisi\u00f3n a negociaci\u00f3n de fichas referenciadas a activos deben estar sujetas a las competencias administrativas establecidas en dicha Directiva y tambi\u00e9n a aquellas previstas en el presente Reglamento, incluida una restricci\u00f3n o limitaci\u00f3n de la actividad de una entidad de cr\u00e9dito y una suspensi\u00f3n o prohibici\u00f3n de una oferta p\u00fablica de fichas referenciadas a activos. Cuando las obligaciones aplicables a dichas entidades de cr\u00e9dito con arreglo al presente Reglamento se solapen con las de la Directiva 2013\/36\/UE, las entidades de cr\u00e9dito deben cumplir los requisitos m\u00e1s espec\u00edficos o m\u00e1s estrictos, garantizando as\u00ed el cumplimiento de ambos conjuntos de normas. El procedimiento de notificaci\u00f3n aplicable a las entidades de cr\u00e9dito que tengan la intenci\u00f3n de ofertar o solicitar la admisi\u00f3n a negociaci\u00f3n de fichas referenciadas a activos con arreglo al presente Reglamento debe entenderse sin perjuicio de las disposiciones de Derecho nacional por las que se transponga la Directiva 2013\/36\/UE que establezcan los procedimientos para la autorizaci\u00f3n de las entidades de cr\u00e9dito a prestar los servicios enumerados en el anexo I de dicha Directiva.&#8221;<\/em><\/p>\n<hr \/>\n<h2 style=\"text-align: justify;\"><span style=\"font-size: 14pt;\">Di\u1ec5n gi\u1ea3i \u2013 Ph\u00e2n t\u00edch chuy\u00ean s\u00e2u: Mi\u1ec5n tr\u1eeb th\u1ee7 t\u1ee5c c\u1ea5p ph\u00e9p th\u1ee9 hai \u0111\u1ed1i v\u1edbi t\u1ed5 ch\u1ee9c t\u00edn d\u1ee5ng khi ph\u00e1t h\u00e0nh token tham chi\u1ebfu t\u00e0i s\u1ea3n<\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"font-size: 14pt;\">\u0110i\u1ec1u (44) t\u1ea1o ra m\u1ed9t c\u01a1 ch\u1ebf linh ho\u1ea1t nh\u01b0ng v\u1eabn b\u1ea3o \u0111\u1ea3m nguy\u00ean t\u1eafc qu\u1ea3n l\u00fd r\u1ee7i ro khi t\u1ed5 ch\u1ee9c t\u00edn d\u1ee5ng mu\u1ed1n ph\u00e1t h\u00e0nh token tham chi\u1ebfu t\u00e0i s\u1ea3n:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-size: 14pt;\"><strong>Kh\u00f4ng y\u00eau c\u1ea7u c\u1ea5p ph\u00e9p l\u1ea1i<\/strong>: N\u1ebfu m\u1ed9t t\u1ed5 ch\u1ee9c t\u00edn d\u1ee5ng \u0111\u00e3 \u0111\u01b0\u1ee3c c\u1ea5p ph\u00e9p theo <strong>Ch\u1ec9 th\u1ecb 2013\/36\/EU<\/strong> (CRD IV \u2013 khung ph\u00e1p l\u00fd cho ng\u00e2n h\u00e0ng t\u1ea1i EU), th\u00ec khi ph\u00e1t h\u00e0nh token tham chi\u1ebfu t\u00e0i s\u1ea3n, h\u1ecd <strong>kh\u00f4ng c\u1ea7n ph\u1ea3i xin ph\u00e9p l\u1ea1i<\/strong> theo Quy \u0111\u1ecbnh MiCA.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\"><strong>B\u1eaft bu\u1ed9c th\u00f4ng b\u00e1o<\/strong>: D\u00f9 kh\u00f4ng c\u1ea7n xin ph\u00e9p, t\u1ed5 ch\u1ee9c t\u00edn d\u1ee5ng v\u1eabn <strong>ph\u1ea3i th\u00f4ng b\u00e1o<\/strong> cho c\u01a1 quan c\u00f3 th\u1ea9m quy\u1ec1n \u0111\u01b0\u1ee3c ch\u1ec9 \u0111\u1ecbnh theo MiCA, nh\u1eb1m gi\u00fap c\u01a1 quan n\u00e0y x\u00e1c minh n\u0103ng l\u1ef1c th\u1ef1c hi\u1ec7n c\u1ee7a ng\u00e2n h\u00e0ng \u0111\u1ed1i v\u1edbi ho\u1ea1t \u0111\u1ed9ng ph\u00e1t h\u00e0nh token.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\"><strong>\u00c1p d\u1ee5ng ch\u1ecdn l\u1ecdc ngh\u0129a v\u1ee5<\/strong>: MiCA <strong>mi\u1ec5n tr\u1eeb m\u1ed9t s\u1ed1 ngh\u0129a
